Terms and Conditions

1.1 These terms apply to the use of Newsy via the website newsy.me and the apps for iOS and Android, to the free account and to all paid plans.

1.2 Newsy is operated by a sole proprietorship based in Switzerland ("we"). The owner's name and postal address are available at newsy.me/en/contact. Email: info@newsy.me.

1.3 The contract for the free account is concluded when you register and accept these terms. The contract for a paid plan is additionally concluded when you buy it (section 9). You must be at least 16 years old.

1.4 How we process personal data is described in the privacy policy at newsy.me/en/privacy.

2.1 Newsy searches publicly accessible news sources for the topics you choose and has the results summarised automatically by an AI system. You receive the briefings in the app, by email or by push notification.

2.2 There is the free plan Free, the paid plans Plus and Pro, and the free plan First Supporters for accounts that existed before the plans launched. The plans differ in the number of topics, the frequency of briefings and the number of on-demand briefings. The plan overview at newsy.me/en/pricing at the time of purchase is decisive.

2.3 We owe that Newsy runs a search for every active topic according to the chosen schedule and creates a briefing or reports that nothing relevant was found. We do not owe that news exists on a topic, that particular media are covered, or that a briefing has a certain length or number of articles.

2.4 Briefings are created fully automatically. Nobody reviews them before they are sent. They may be wrong, incomplete, outdated, shortened or misleading, and may attribute statements to the wrong sources. The original article linked with the briefing is always decisive.

2.5 Newsy is not a journalistic service and takes no editorial responsibility for the content of the sources.

2.6 The summaries and the search assistant rely on third-party AI services (currently Anthropic). We do not control their output in detail. Clause 2.4 applies to every output of these services.

3.1 Newsy does not provide investment, financial, legal, tax, medical or any other advice and makes no recommendations. Briefings are not an invitation to buy, sell or hold securities, cryptocurrencies or other financial instruments.

3.2 Where briefings contain prices, price targets, forecasts, assessments or opinions, these come from the sources and not from us. We do not adopt them as our own.

3.3 Decisions you make on the basis of briefings are your own responsibility. Check important information in the original sources and seek professional advice where needed.

4.1 The linked articles and their content belong to the respective media and rights holders. We give no warranty for their accuracy, lawfulness, licensing or availability, nor for linked pages.

4.2 Newsy restates facts from the sources in its own short words and links to the original. Source texts are not reproduced in full.

4.3 If you are a rights holder and believe your rights are infringed, write to info@newsy.me. The notice includes your name and contact details, the work concerned, the briefing in question, a short reason and confirmation that you are the rights holder or authorised to report. We review the notice and promptly remove the content concerned if the notice is justified.

5.1 Newsy and every paid plan are intended for your personal, non-commercial use. An account may not be shared with others. You may not systematically redistribute, publish or sell briefings.

5.2 In particular, it is not permitted to read Newsy out automatically, to circumvent limits, to create several accounts to circumvent limits, to disrupt the service, to create topics with unlawful content, or to enter personal data of third parties into topics or messages to the assistant without their consent.

5.3 On-demand generations and requests to the assistant are sized for normal personal use. We may limit them per plan. The limits are shown in the app.

5.4 Keep your login details secret. You are responsible for actions taken through your account to the extent you are at fault.

5.5 We use topics, search terms and messages to the assistant only to operate Newsy for you. For this we pass them on to the services under clause 6.2. We do not use them to train AI models.

6.1 We strive to offer Newsy reliably but do not guarantee any particular availability or punctual delivery. Newsy may be temporarily unavailable for maintenance.

6.2 Newsy uses third-party services, for example for hosting, search, AI, email, push and payment (see the privacy policy). If these fail, change their terms or discontinue their service, Newsy may fail in whole or in part. We may change third-party services.

6.3 We may develop, change or discontinue features. If we materially restrict the scope of a paid plan, we will announce this at least 30 days in advance, and clause 12.2 applies.

7.1 We are liable without limitation for damage we cause intentionally or through gross negligence, and for damage resulting from injury to life, body or health.

7.2 Otherwise, our liability for slight negligence is excluded. Where the law of your place of residence mandatorily provides for liability for the slightly negligent breach of essential contractual obligations, it is limited to the damage typical for the contract and foreseeable at the time of conclusion, and additionally to the amounts you paid us in the twelve months before the event causing the damage. Essential obligations are those without which the contract cannot be performed and on whose fulfilment you may regularly rely.

7.3 To the extent permitted by law, we are not liable for auxiliary persons or for third-party services under clause 6.2 (Art. 101 para. 2 Swiss Code of Obligations).

7.4 Unless otherwise provided in 7.1 to 7.3, we are in particular not liable for: errors in AI summaries; the content, accuracy or rights of the sources; losses from investments, transactions or other decisions you make on the basis of briefings; lost profits and consequential damage; loss of data; failed, delayed or incomplete deliveries.

7.5 Mandatory statutory liability, for example under the Swiss Product Liability Act, remains unaffected.

If you culpably breach these terms and a third party makes a claim against us as a result, you will compensate us for the resulting damage, including reasonable costs of legal defence.

9.1 You buy paid plans in the Newsy app for iOS or Android, through Apple's App Store or Google Play. We do not sell plans on the web or by any other means.

9.2 Apple or Google is the seller. They show you the binding price in your currency, including any taxes, before purchase and process the payment. Their terms also apply to payment, renewal, cancellation and refunds. Where they take precedence over these terms, they apply. The prices on newsy.me/pricing are the prices for Switzerland.

9.3 We are responsible for Newsy itself, that is, the scope and operation of the plan.

9.4 A plan applies to the Newsy account you were signed in to in the app when you bought it, on all devices and on the web.

9.5 Apart from purchase and payment under section 9.2, Apple and Google are not parties to these terms and are not responsible for Newsy, its content, maintenance or support.

10.1 Plans run for one month and renew automatically for another month until you cancel. Apple or Google charges the price for the new period to the payment method of your Apple or Google account.

10.2 You can cancel at any time, in the subscription settings of your Apple ID or in Google Play. The settings in Newsy take you there. We cannot cancel a subscription for you. Cancellation takes effect at the end of the current period. The plan remains active until then.

10.3 If you delete your account, we cancel a subscription bought on Google Play with the deletion; it will not renew afterwards. Only you can cancel a subscription bought on the App Store. Cancel it first in your Apple ID subscription settings, otherwise it keeps renewing. We will remind you before deletion. There is no pro-rata refund for the remaining period.

10.4 If a payment cannot be charged, Apple or Google will retry it under their rules. If it does not succeed, the plan ends and the limits of Free apply.

In Switzerland there is no statutory right of withdrawal for online purchases. Mandatory rights under the law of your place of residence remain reserved. Apple's or Google's rules also apply.

12.1 Refunds are decided by Apple or Google under their rules. Please send such requests to them. As a rule, we do not refund periods already paid ourselves, not even pro rata if you cancel during the term.

12.2 Exceptions: if Newsy is unavailable for more than seven consecutive days, if we terminate a paid plan without a breach on your part, or if we materially restrict it under clause 6.3 and you cancel for that reason, we will refund the pro-rata price for the affected period on request.

12.3 Further claims due to outages exist only under section 7. Mandatory rights remain reserved.

13.1 You change your plan in the app. The timing and billing of a change follow Apple's or Google's rules. The new scope applies as soon as the change takes effect there.

13.2 We announce price increases at least 30 days in advance. They apply only from the next period. If Apple or Google requires your consent and you do not give it, the subscription ends at the end of the current period.

13.3 If a plan ends or you switch to a smaller one, its limits apply. Topics above the limit are paused, not deleted. You choose which ones stay active.

13.4 The First Supporters plan is free and applies indefinitely to accounts that existed before the plans launched. It cannot be purchased. If we change it, we will announce this at least 30 days in advance. If you buy a paid plan as a First Supporter, you leave First Supporters permanently. When the paid plan ends, Free applies.

Software, design and the Newsy brand belong to us or our licensors. For the duration of the contract you receive a simple, non-transferable right to use Newsy for the purpose of these terms.

15.1 We may terminate free accounts by email with 30 days' notice.

15.2 In the event of serious or repeated breaches of section 5, we may block an account immediately and terminate the contract without notice. In this case we do not refund amounts paid, unless mandatory law provides otherwise.

15.3 If we discontinue Newsy entirely, we will announce this at least 30 days in advance and refund amounts paid for the period after discontinuation pro rata.

We may change these terms. We will notify you of changes at least 30 days in advance by email or in the app. Material changes apply only once you accept them in the app. If you do not accept, you can delete your account and cancel a running subscription. Clause 12.2 then applies accordingly.

17.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain reserved.

17.2 The place of jurisdiction is Zurich, Switzerland. Mandatory places of jurisdiction, in particular for consumers at their place of residence, remain reserved.

17.3 If a provision is invalid, the remaining provisions remain valid. In the event of discrepancies between language versions, the German version prevails.
